It any special arrangement is made by the recipient of letters by which delay occurs in delivery, the person serving or giving notice by post under proper authority is not to be prejudiced by such special arrangement, but is deemed to have effected service within the time of ordinary delivery {Kemp Wauklyn, [1894] 1 Q B 583).

{a) In the Law of Distress.

In the law of distress " day " means dies artificialis, i E from sunrise to sunset {Tutton Darke, 1860, 2 T 361).

The judgment in that case leaves it doubtful whether the almanac is to be accepted as determining the time of sunrise or sunset.

In Collins Nokes, 1849, 3 Car & Kir 1013, it was stated that the Court would take judicial notice of the days in the calendar, but not of the hours, for the purpose of ascertaining whether the sun had set or not.
